By making a Booking, you acknowledge that you have read, understood and agree to our Terms & Conditions.

1. BOOKING:

Your booking is confirmed when you have completed our booking form, paid us a deposit (or other amounts owing at the time of booking), and we have sent you a Booking Confirmation.

INCLUSIONS: All goods and services that are included in your tour are as listed in the itinerary on our website as at the date of booking.

SPECIAL REQUIREMENTS: It is your obligation to notify us of any special requirements (for example diet) at the time the booking is made. When advised, we will endeavour to ensure your requirements are met however, we cannot guarantee they will be met in all instances. In the unlikely event that your special requirements cannot be met we will negotiate alternative arrangements with you.

2. PAYMENT :

The fare for your tour is the amount stated in your Booking Confirmation. All fares include Australian Goods and Services Tax (GST) and are quoted in Australian Dollars ($AUD).

You must pay the Fare in two parts: The deposit is $100 payable at the time of booking by direct deposit or bank transfer (we do not accept credit cards). The balance (the difference between the deposit and the fare) is to be paid no later than 8 weeks prior to the date of travel. For bookings made within 8 weeks of the date of travel, the balance will be required within 7 days, and in all cases before the date of travel.

3. LUGGAGE LIMITS

You are entitled to take one medium size soft bag weighing no more than 14 kilograms. This limitation is due to space and loading restrictions on our buses. Passengers may also take on board one item of hand-luggage per person. This item should be small enough to fit under your seat or on the floor between your feet.

4. TRAVEL INSURANCE

Exploranges strongly recommends you take out travel insurance to cover any unforeseen circumstances. We recommend comprehensive travel insurance to cover cancellation, medical requirements, medical evacuation, luggage and additional expenses. The choice of insurer is yours. We strongly suggest you purchase insurance at the time you pay your Deposit. This is because cancellation fees may be payable from that time. Whilst travel insurance is not compulsory, ambulance cover is mandatory for all travelers.

5. ON BOARD WITH US

NO SMOKING POLICY: Our vehicles and tents are all entirely smoke free in accordance with relevant state and territory government regulations. Passengers are not to smoke (including ecigarettes) while on board the bus or inside of tents.

SEAT ALLOCATIONS & SEATBELTS: Seat allocations on board Exploranges tour vehicles operate with a daily seat rotation system to ensure all passengers enjoy different seating positions whilst on tour. Where a vehicle, vessel or aircraft is equipped with seatbelts, you must always wear your seatbelt when onboard. To the fullest extent permitted by law, our liability to you for any personal injury, death or other damages or claims arising from an accident or incident involving a vehicle, vessel or aircraft you are travelling on as part of the Journey will be limited or excluded to the extent your failure to wear a supplied seatbelt contributed to or caused your injury or death.

HEALTH: Most of our tour itineraries contain guided walks to natural attractions. As such, you are required to have a reasonable level of fitness in order to participate. The walks on our tours vary in length and difficulty, they range from quite gentle to very vigorous so please read your chosen itinerary for further information or contact us if you have any questions. If you feel that you are unable to participate in the walk on the day, alternative arrangements may be made on a case by case basis. Hydration whilst on a bushwalk is your responsibility. We will ensure that you carry adequate drinking water. Bottles are supplied or you can bring your own. Due to space restrictions on board our buses, we are unable to accommodate passengers who require the use of wheelchairs or walkers. Our vehicles are not equipped with wheelchair ramps or lifters. Passengers requiring physical or mental assistance must be accompanied by a companion who is willing and capable of providing such assistance.

SAFETY & RISK ACCEPTANCE: Exploranges have appropriate safety procedures for all activities but our tours include participation in Recreational Services and Recreational Activities which may involve certain risks and dangers beyond our control. Such activities containing risks include but are not limited to: bushwalking, swimming, and travelling in remote undeveloped locations. You acknowledge that all Recreational Services and Recreational Activities in connection with the tour are undertaken of your own free will and at your own risk. You acknowledge that your tour may expose you to inherent personal risks which may be greater than those present in your everyday life. This could be because of the adventurous nature of the tour, travelling through and visiting remote destinations, and interactions with wildlife. You travel on the basis that you accept these inherent risks and that to the fullest extent permitted by law we will not be responsible for any personal injury or death resulting from the realisation of an inherent risk. You acknowledge and agree that your participation in certain activities may be subject to you agreeing to a form of risk acceptance and waiver of liability for participation in the activity. Exploranges reserve the right to remove you from our tour if your health or conduct is deemed to be placing your safety, or the safety of others, at risk.

TRAVELLING TO REMOTE AREAS: Some tour itineraries include visits too and overnight stays in remote areas located some distance from hospitals, medical centres or other forms of professional medical facilities. We often travel through extremely remote country for days on end. Booking on these tours means that you accept the risk associated with travelling to remote areas.You acknowledge that there may be occasions where you require first aid due to an accident, illness, injury or other health condition. You consent to our personnel providing you with first aid on the basis that:
(a) our personnel are not qualified medical professionals;
(b) we make no warranties and expressly disclaim all warranties regarding the standard of care that may be provided; and
(c) to the fullest extent permitted by law we will not be liable (and neither will our personnel) for any care given or omitted.
If you are unable to do so yourself, you consent to us seeking and securing any medical treatment that we reasonably consider you require. This may include attendance or evacuation by the Royal Flying Doctor Service or a similar service which is why ambulance cover is mandatory. You agree to reimburse us for any costs we incur in seeking medical treatment on your behalf.

6. AMENDMENTS AND CANCELLATIONS

If you need to cancel your booking with us, you must notify us in writing or by email to info@bushwalkingtours.com.au and pay a cancellation fee as set out below. If cancellation is made at least 56 days prior to departure date, then a full refund will be made. If cancellation is made 28 to 56 days prior to departure date then the deposit is forfeited or transferred to another tour. If cancellation is made less than 28 days prior to departure then no refund will be made unless the trip position can be filled.

OUR AMENDMENTS: We may need to alter or amend itineraries, excursions, accommodation or sightseeing arrangements from those published, with little or no notice. This may be due to road conditions, weather, cultural considerations, safety factors and other operational considerations or government regulations or directions. Such decisions will be made in the best interests of your comfort and safety, or where required by law. In these circumstances Exploranges will endeavour to make suitable alternative arrangements.

OUR CANCELLATIONS : If an event occurs that is outside of our control, and not reasonably foreseeable or preventable by our business, and this event leads to the suspension or cancellation of your tour booking, we will provide you with a refund equal to the value of the monies paid for that booking.

7. OUR OPERATIONS, RESPONSIBILITY & LIABILITY

Exploranges accepts no responsibility or liability for any injury, loss, damage, change of itinerary or inconvenience caused either directly or indirectly as a result of events which are outside of our control, including but not limited to: fires, floods, acts of God, unusually severe weather, riot, war, invasion, medical outbreak or contamination of any kind, material change in legislation or government directions, industrial action or commercial flight disruptions. Exploranges is unable to guarantee exact arrival or departure times and is not liable for any failure to make connections with any other service or guarantee the operation of any particular service. You are encouraged to allow for some flexibility when making your travel arrangements.

PRIVACY: Exploranges respects your privacy and will only use your personal information in accordance with the Privacy Act 1988. Exploranges may take photographs or make recordings of you and your activities that identify you during the tour. We reserve the right to use any images and/or recordings for promotional and marketing purposes. You consent to this use and acknowledge you will not be entitled to any payment or other compensation. If you do not consent to the use of your image or likeness, please advise us as least 21 days prior to the commencement of your journey.
